I. SCOPE
The policies and procedures provided herein apply to all administrative
and professional faculty, full and part-time classified, and all wage
employees of George Mason University, at all University locations.
II. POLICY STATEMENT
The abuse of drugs and alcohol by employees is incompatible with the goals
of George Mason University. The illicit use of drugs and alcohol could
create a serious threat to the safety and welfare of the university community,
as well as undermine the productivity of the workforce.
III. DEFINITIONS
Alcohol - Any product defined as such in the Alcohol
Beverage Control Act, section 4.1-100 of the Code of Virginia, as amended.
Controlled Drug - Any substance defined as such in the Drug Control Act, Chapter 34, Title 54.1 of the Code of Virginia, as amended, and whose manufacture, distribution, dispensation, use, or possession is controlled by law.
Criminal Drug Law - Any criminal law governing the manufacture,
distribution, dispensation, use or possession of a controlled drug.
Conviction - A finding of guilty (including a plea of
guilty or nolo contendere), or imposition of sentence, or both, by any
judicial body charged with the responsibility of determining violations
of the federal or state criminal drug laws, alcohol beverage control laws
or laws that govern driving while intoxicated.
Other Drugs - Any substance other than alcohol (e.g. Over the Counter (OTC) or physician prescribed) medications or that may be taken in to the body and may impair mental facilities and/or physical performance.
IV. RESPONSIBILITIES
A. The Assistant Vice President of Human Resources & Payroll and the
Employee Relations Director, Human Resources, Provost, and Assistant Provost
for Personnel and Budget, Office of Equity and Diversity are responsible
for the administration and implementation of this policy.
B. The Director of Employee Relations, Human Resources is responsible for 1) management of this policy, 2) insuring that all new employees are made aware of this policy and sign the statement acknowledging receipt of the information and 3) assisting supervisors regarding appropriate discipline and personnel action.
C. The Occupational Health Office is responsible for 1) providing supervisory training in dealing with suspected substance abuse issues for 2) providing for medically appropriate testing sites and reviews by a certified Medical Review Officer and 3) insuring that all medical and testing results remain confidential.
D. The Office of Equity and Diversity is responsible for addressing any
issues that may impact an employee’s protection under the Americans
with Disabilities Act.
V. COMPLIANCE
All employees must be informed of the University’s Drug and Alcohol policy upon appointment and will be required to sign the Commonwealth’s Policy Statement on Alcohol and Drugs.
Supervisors are required to report and document any incident relating to the possible abuse of alcohol and drugs to the Director of Employee Relations, Human Resources.
Employees must notify their supervisor immediately following their conviction
of any federal or state alcohol or substance abuse laws.
VI. EFFECTIVE DATE AND APPROVAL
This policy is effective April 18, 2005. This Administrative Policy shall
be reviewed and revised, if necessary, annually to become effective at
the beginning of the University's fiscal year, unless otherwise noted.
